A former employee of Financial Reporting council of Nigeria (FRCN) Pastor(Mrs) Abimbola Patricia Yakubu has slammed N100million suit on the Executive Secretary of the council, Jim Osanyande Obazee over an alleged serial acts of sexual harassment,sexual advances , seduction with attendant trauma and emotional trauma.
Joined as co-defendant in the ensuing legal battle is financial Reporting council Nigeria itself. Pastor Abimbola Yakubu is also challenging the termination of her appointment from the services of FRCN.
In a 54 paragraphs of statement of facts filed before National Industrial Court of Nigeria sitting in Lagos by a Lagos Human Right lawyer Prince Hilary Oshoma,the claimant averred thus, she was employed on 28th of February 2008 as Deputy Manager Administration on grade level 10 step 2 and through hard work and performance earned promotion to Grade level 12 step 2.
During this period she worked in the Admin Department and Library until 2010 when she was deployed to the executive office directly presided over by Jim Osayande Obazee.
However before her deployment, when she was serving in the administrative department and library Jim obazee was then the technical Director, she was on several times and instances met with, and subjected to incessant seductive, infidel and serious compliments and gestures by Jim Obazee, and on her continuous rebuff, Jim Obazee resorted to unnecessarily harassment and would not mind scolding her over mundane issues even at a time when she was heavily pregnant of her 3rd baby, she then tried as much as possible to avoid him until when she was deployed to the library unit which is one of the units under the direct headship this provided him opportunity to further pester her for seduces advances, as he always come to the Library not to read, but to indulge in endless gist with her, and thereafter invite her to his office for promiscuous and obscene talk.
The last straw that broke the camel’s back was when Jim Obazee became the acting Executive secretary before his appointment was confirmed in July 2010, he then ordered her deployment from library to the Executive office as the Executive office manager.
Pastor Abimbola averred further that no sooner had she resumed that the defendant heightened his sexual advances to the extent of condescend to the abysmal and ridiculous of kneeling down, to beg her to offer him sex, professing that he had always loved her, and that her love is really eating him up.
Subsequently, the defendant in a bid to achieve his plot and desires of having sex with her scripted and profiled the claimant to travel round the country together with him, purportedly on official duties to places like calabar, Uyo, Enugu, Ibadan, Ijebu-Ode, Abuja and Minna, where in all of the times after parties have retired to their hotel rooms, Jim obazee would either call or invite her to come over to his room, or that he shall be coming to her room, but in all these, she had at all times successfully rebuffed the defendant.
She wish to rely on call logs of their phone numbers during the trial of this case.
During the FRCN’s press retreat in December 2012 at Akodo when as usual she had retired into her room, Jim Obazee came to her room to beg for sex but she resisted, and advised him to re-channel all his love and affection to his wife; after the retreat he made her redundant at work by assigning all her work schedules to her subordinates and refused her all privileges.
On Friday 24th of May 2013, she received a letter of transfer from Lagos to FRCN liaison desk at the corporate affair commission in Kaduna. Thereafter, Jim Obazee scrapped the office of the Executive office manager which she had occupied.
The claimant averred that she accepted and complied with the punitive transfer in good faith even without due allowances paid to her. However, few days after her resumption in Kaduna, she received a memo directing her to report to a grade level 08 officer, and on account should she be granted the indulgence to leave her duty post without clearance from his junior officer who in turn must receive directive from Jim o0bazee directly in Lagos, this he boasted would frustrate her to resign from the employment of FRCN.
Thereafter the claimant reported her ordeals to the chairperson of FRCN, who promised to look into the matter and get back to her but nothing was done, consequently she wrote a letter to the permanent secretary of the ministry of industry, trade and investment which is the supervising ministry but nothing was done.
She also petitioned minister of the supervising ministry and copied the permanent secretary and the chairperson of FRCN in the face of no intervention.
Along the line, FRCN convened a management meeting, and she was invited for clarification on the allegation of posting her petition on an online website, gongnews even though no query was issued to her.
She denied the posting of the petition on any website, thereafter she was invited to the commission’s head office in Abuja where she met six members of FRCN board who conducted Kangaroo trial devoid of fair hearing.
On the 27th September when she was on sick bed despite the fact that she sent excuse duty certificate to the office, she got a call from the Human Resources office that she should not resume in Kaduna office but should report at the Lagos office, but before she could report in Lagos office, she was posted a letter purportedly terminating her appointment with the FRCN.
In view of this scenario she is seeking a mandatory order of the court directing the FRCN to reinstate her or in the alternative to Pay her N24,594,836.04 being her salaries and other entitlement for 28years from October until retirement age of 60 years.
Damages in the sum of N100million specifically and personally against Jim Osanyade Obazee for his serial act of sexual harassment plus post judgment interest of 15percent until the sum is liquidated and N10million as the cost of this legal action.
In a joint statement of defense filed before the court by Barrister Adesegun Ajibola SAN on behalf of financial reporting council of Nigeria, and Jim Osayande Obazee, the defendants denied almost all the allegations contained in the statement of facts and alleged that after the employment of the claimant she was granted series of leave, promotion and salary increase.
The FRCN states that prior to deployment of the claimant to Jim Obazee’s office, the defendant had worked in different capacities without blemish or allegation non the least “sexual harassment what so ever, and he had been performing his obligation to FRCN with utmost good faith.
Soon after the claimant was deployed to serve as Executive office manager to the defendant, she exhibited the following traits to wit poor performance from poor attitude and disposition to work, low productivity and laziness, dishonesty with the handling of impress kept in her custody, the claimant was advised to improve her attitude to work but persisted with her shoddy ways.
The defendant alleged further that sometime in 2012, the claimant introduced her husband who is also a Pastor to Jim Obazee, and informed him of the need to offer prayer for him, and in addition indicated a prophesy that Jim Obazee will soon be promoted to higher office in Nigeria. Therefore need to rid his office of some perceived evil forces, and enemies among the members of staff of FRCN, but the defendant refused to yield to their demand claiming that Almighty God will be there for him.
Jim Obazee averred further that it became obvious that the claimant would not improve or meet up with the standard demanded by her office, he had no choice than to transfer her to Kaduna in line with the public service rules on 22nd of May 2013 but the claimant resumed two. days later than resumption date, and started to play truancy with her work, therefore the vexatious allegation of sexual harassment are mere figment of the claimant.
Consequently the defendant contended that the termination of her appointment followed due process therefore her claims are vexatious and gold digging, and should be dismissed with substantial cost.
The presiding judge has adjourned for further hearing.
